Based on the current Italian legislation (D. Lgs. 71/2011), notary services of our Consulate General are provided only to Italian nationals who are permanently or temporarily abroad.
The office assists in issuing notary deeds. The service is provided exclusively by appointment and only to Italian citizens. To book an appointment applicants must send an e-mail to notarile.vancouver@esteri.it. It is strongly recommended to attach a draft of the document that needs to be signed (as a Word document).
Following Canada’s ratification of The Hague Convention, as of January 11, 2024, a new authentication procedure known as the Apostille has replaced the consular legalization on Canadian deeds and public documents in order for them to be valid in Italy.
Notary documents that are signed by Italian citizens at our Consulate General do not need the Apostille to be accepted in Italy.
For a power of attorney (Procura speciale or procura generale) of an Italian citizen (not signed at our Consulate General) or of a foreign citizen to be valid in Italy it needs to:
- be undersigned in front of a Canadian lawyer and/or notary public;
- bear an Apostille issued by the competent local authorities:
- British Columbia: https://www2.gov.bc.ca/gov/content/governments/government-id/guide-to-the-authentication-of-documents/about/apostille;
- Alberta: https://www.alberta.ca/document-authentication-other-jurisdictions-countries;
- Saskatchewan: https://www.saskatchewan.ca/government/notarized-documents-legislation-maps/authenticating-notarized-documents;
- Yukon: https://www.international.gc.ca/gac-amc/about-a_propos/services/authentication-authentification/step-etape-1.aspx?lang=eng.
- be translated into Italian, if the original is in English. Our Consulate General does not provide translation services but can exclusively legalize the signature of one of the certified translators from English into Italian listed in the file published in the Forms section under “Lists of Professionals”. In order to be legalized, the certified translation must be submitted along with the original document bearing the Apostille and the request form SCIV01 . The consular fee for the legalization of the translator’s signature is indicated by Art. 69 of the Table of consular fees .
Legalization services
Following the implementation of the Apostille, the service provided by the Notary Services Department of the Consulate General of Italy in Vancouver and by the Consular Branch in Edmonton is limited to:
- legalization (by email or by appointment) of the Italian translation of documents drafted in English and
- authentication of the signature placed by an Italian citizen on documents (written declarations, forms and similar documents), exclusively by appointment.
